South Africa’s Constitutional Court has blocked Shell’s plans to conduct offshore oil exploration along the country’s ecologically sensitive Wild Coast, delivering a major setback to the oil giant after years of legal challenges by local communities and environmental groups.
The court issued its ruling on Aug. 14, 2026, overturning a 2024 judgment by the Supreme Court of Appeal that had allowed Shell and Impact Africa to proceed with seismic surveys off South Africa’s east coast under an exploration right granted in 2014.
The ruling is the latest in a series of legal battles that have delayed offshore oil and gas exploration in South Africa. Reuters reported Aug. 14 that the cases have “dampened investor appetite” and contributed to delays in offshore exploration.
Delivering the judgment, Justice Jody Kollapen said: “The order of the Supreme Court of Appeal is set aside.”
The case centred on whether authorities had adequately consulted communities before granting Shell the right to conduct seismic surveys in the Wild Coast region. Local communities and environmental groups challenged the exploration plans, arguing that the consultation process had failed to adequately involve people who could be affected by the project.
Delme Cupido, a director at Natural Justice and one of the applicants in the case, said the ruling affirmed that public participation is “not just about following a procedure and ticking boxes”, but about placing “the dignity of our people at the centre of developmental decisions that will affect them.”
Shell said it had noted the judgment and remained committed to “responsible offshore exploration, meaningful stakeholder engagement and environmental stewardship.”
The company is also pursuing exploration opportunities in South Africa’s Orange Basin, off the country’s west coast, where it has interests in offshore oil and gas prospects.
The Constitutional Court ruling closes the latest legal challenge to Shell’s Wild Coast exploration plans, but it also underscores the growing legal and social scrutiny facing oil and gas companies seeking to expand exploration along South Africa’s coastline.
For communities and environmental groups, the case highlights the importance of meaningful public participation in decisions over fossil fuel projects that could affect livelihoods, marine ecosystems and coastal communities.
